Personal Perspective on Special Education Law

As the parent of 2 children with special needs I understand how devastating it is when your child is diagnosed with a developmental delay or a learning disability. I know how confusing the special education system is and how difficult it can be to obtain appropriate services for your child. The Law Offices of Marna E. Solarsh are located in White Plains, New York. The focus of my law practice changed direction 16 years ago when my daughter was diagnosed with autism. At that time there was not much information available on educating children with autism and there were very few programs available. After attending my first meeting with the committee on special education I realized how little I knew about the special education system and what services my daughter was entitled to receive. I became familiar with special education law and regulations so that I could become an effective advocate for her. The special education system is complex and can be intimidating to parents. I decided to use my personal and professional experience to help other families obtain appropriate programs and services for their children.

Individual Education Plans

I will work with you and your school district to develop an individualized education plan that provides for an appropriate educational program and related services to address your child’s needs. This plan is highly individualized and is designed so that your child can make meaningful progress in school.

Any  child in New York State between the ages of 3 and 21 who meets the eligibility criteria under the Individuals with Disabilities Education Improvement Act of 2004 (“IDEA 2004”) is entitled to a free and appropriate education at no cost to the family. A child who does not qualify under the IDEA 2004 may still be entitled to receive services and accommodations under Section 504 of the Rehabilitation Act. I will advocate to ensure that your child receives an educational program based on his or her needs. This could be a special class or school, related services such as speech and language or occupational therapy, an aide to assist in the classroom, testing modifications and accommodations or the opportunity to participate in after school activities.

As the parent of a child with special needs you know how important it is that your child receive the proper instruction and assistance while in school. Time goes so fast and your child cannot afford to miss out on any learning opportunities. I will work with you and your school district to put an appropriate and effective educational plan in place for your child.
